Punishment for attempting to commit offences punishable with imprisonment for life or for a shorter terms:

Whoever attempts to commit an offence punishable by this Code with imprisonment for life or imprisonment, or to cause such an offence to be committed, and in such attempt does any act towards the commission of the offence, shall where no express provision is made by this Code for the punishment of such attempt, be punished with imprisonment of any description provided for the offence for a term which may extend to one-half of the longest term of imprisonment provided for that offence or with such fine daman as is provided for the offence, or with both.

Illustrations

(a) A makes an attempt to steal some jewels by breaking, open the box, and finds after so opening the box, that there is no jewels in it. He has done an act towards the commission of theft, and therefore is guilty under this section.
 
(b) A makes an attempt to pick the pocket of Z by thrusting his hand into Z's pocket, A fails in the attempt in consequence of 2's having nothing in his pocket. A is guilty under this section.
 

Offence Cognizance Summons Bail Punishment Triable

According as the offence is one in respect of which the police may arrest without warrant or not. According as the offence is one in respect of which a summons or warrant shall ordinarily issue According as the offence contemplated by the offender is bailable or not. imprison-ment not exceeding half of the longest term, and of any description, provided for the offence, or fine 2[daman], or both. If punishable with death, imprisonment for life, imprisonment exceeding seven years, amputation of hand or foot or both hand and foot or with whipping exceeding 80 stripes with or without any other of the said punishment May arrest Without warrant. Warrant .. Not bailable. Court of Session
If punishable with imprisonment for three years and upwards but not exceeding 7 years or with whipping not exceeding 80 stripes with or without imprisonment Do Do Do Court of Session or Magistrate of the first class.
If punishable with imprisonment for 1 year and upwards but less than 3 years or with whipping not exceeding 40 stripes with or without imprisonment. Shall not arrest without warrant Summons. Bailable. Magistrate of the first or second class.
If punishable with Imprisonment for less than 1 year or with whipping not exceeding 10 stripes with or without imprisonment, or with fine only. Do Do Do Any Magistrate
Zina Section 5 of Ordinance VII of 1979 Shall not arrest without warrant. Summons. Bailable Stoning to death in case of Muhsan and if not Muhsan whipping not exceeding one hundred stripes. Court of Sessions
